ZBA Minutes OCT 25 2012
The Zoning Board of Appeals of the Town of Avon held a meeting on Thursday, October 25, 2012 at the Avon Town Hall.  Present were Messrs. Ladouceur, Ryan, McNeill, Ms. Aube, Ms. Hard, and Mr. McCahill Planning & Community Development Specialist.  Mr. Ladouceur called the meeting to order at 7:31 p.m.

PUBLIC HEARING                                                                 October 25, 2012

The Clerk read the call to meeting.

Mr. Ladouceur read the Application of Gregory D. & Kristin A. Webster, owners/applicants; requesting from the Avon Zoning Regulations, Section IV.A.6., a 25’ variance from the 40’ front yard setback requirement to permit a 8’ x 12’ shed located at 4 Orchard Farms Lane in an R-15 zone.  

Ms. Webster, the applicant, was the only person present.

Ms. Webster stated that they had spoken to the abutting property owners to the rear of their property, the Tussins, 11 Orchard Street, and to the front of their property, the Derderians, 22 Orchard Street, and have not received any objections to the placement of the proposed shed location.  Ms. Webster submitted a letter in favor of the application from Art Derderian Jr.

Mr. McCahill stated that the property is a corner lot and, therefore, subject to two (2) forty foot (40’) front yard setbacks.  He continued by stating that in order to be fair to the applicants they are given the benefit of two (2) fifteen foot (15’) side-yard setback requirements to allow for a little more room.

There were no other questions or comments on the application.

Application of Jay R. & Lisa F. Clark, owners/applicants; requesting from the Avon Zoning Regulations, Section IV.A.6., a 24’ variance from the 30’ rear yard setback requirement to permit a 12’ x 24’ shed located at 250 Arch Road in an R-40 zone.

Mr. Ladouceur stated that a letter from the applicant, Jay R. Clark, received October 24, 2012, had been submitted to the Town requesting that his application for a variance for the property at 250 Arch Road be withdrawn.  Mr. Ladouceur also stated that a letter from Mr. McCahill, dated October 25, 2012, was sent to Mr. & Mrs. Clark as confirmation that their application will be withdrawn and no public hearing will be held.

Mr. Ladouceur read the Application of Andrew J. MacDonald & Elizabeth A. Belanger, owners/applicants; requesting from the Avon Zoning Regulations, Section IV.A.6., a 9’ variance from the 25’ side yard setback requirement to permit a second bay addition to existing garage located at 162 Arch Road in an R-40 zone.

Ms. Belanger submitted a letter from an abutting property owner, William & Mary Ann Berg, 156 Arch Road, in favor of the application. The Berg’s property abuts the applicant’s property on the same side as the requested variance.

Ms. Belanger stated that the garage expansion is needed for cars and storage and has ensured that the expansion, including landscaping and retaining wall, will fit in aesthetically with the house and the neighborhood.  She added that the proposed garage will be approximately 28’ x 24’.

Mr. Ladouceur inquired if the shed located easterly on the property still existed.

Mr. MacDonald & Ms. Belanger confirmed that the shed still exists.
Mr. McCahill clarified that there was a point in time (about six or seven years ago) that building permits were not required for sheds that were under a certain square footage.  Because of this, there are some sheds that are legally non-conforming.

Mr. McCahill confirmed that the nine foot (9’) variance would be sufficient for the expansion.

There were no other questions or comments on the application.

There was no one else present.  The Public Hearing closed at 7:45 p.m.

ZONING BOARD OF APPEALS MEETING                  October 25, 2012

A Zoning Board of Appeals meeting was held following the Public Hearing.

Ms. Hard made a motion to GRANT, seconded by Ms. Aube, the Application of Gregory D. & Kristin A. Webster, owners/applicants; requesting from the Avon Zoning Regulations, Section IV.A.6., a 25’ variance from the 40’ front yard setback requirement to permit a 8’ x 12’ shed located at 4 Orchard Farms Lane in an R-15 zone.  

The vote was unanimous by Messrs. Ladouceur, Ryan, McNeill, Ms. Aube and Ms. Hard.

Reason – The granting of the variance will be in harmony with the purposes and intent of these regulations, will accomplish substantial justice and will not be injurious to the neighborhood or otherwise detrimental to the public, health, safety and welfare.

Hardship – To deny would deprive the owner of a reasonable use of the property.

Ms. Aube made a motion to GRANT, seconded by Mr. McNeil, the Application of Andrew J. MacDonald & Elizabeth A. Belanger, owners/applicants; requesting from the Avon Zoning Regulations, Section IV.A.6., a 9’ variance from the 25’ side yard setback requirement to permit a second bay addition to existing garage located at 162 Arch Road in an R-40 zone.

The vote was unanimous by Messrs. Ladouceur, Ryan, McNeill, Ms Aube and Ms. Hard.
